SELAT UNDER SIEGE

Short chronicle of events:

15th January (Friday) @ about 4.00pm, a group of people lead by Bong Meow Cheng, Nancy Gan, Rosemary Lee and later joined by Chew Chin Tai, stormed into the management office. The manager was manhandled by big sized men employed by them and forcefully pulled him out of the office. The 2 lady staffs were threatened into handing over the keys, monies, cheques and documents to the group.

The management council is taking legal steps in claiming back the office and urge all owners to be patient as the process takes time. The forceful takeover was done without any proper documents or court order.

The management office under very secure locks. 2 of theirs and 2 of ours.

At 12.00 pm on 20/1/2010 (Wednesday), an Investigating Officer with a police cameraman came to take photos of the management office. Both parties unlocked the padlocks for them to enter.

Besides locking out the staffs and denying the local councilors entry, the group has also employed their own security guards who are trespassing.

What these people don't realise is the danger that is looming over Selat Horizon.

The LT room needs immediate and urgent repairs.

As long as it is not dealt with, should there be a fire in Selat Horizon, the will be no water supply to all the floors because there is no supply of electricity to the firefighting pump.

Rubbish not collected because the group has taken all the keys, which means the guards cannot open the door for the rubbish collectors.

Burst water pipe and lift damage

Dear All,

Last night between 2.00am and 3.30am, the outgoing water pipes in the First Floor (Mutiara Block B) Meter Room was found flooding the public corridor and it flooded all three lifts in Mutiara Block by the night shift guards.

The maintenance man was informed and he rushed to Selat by 4.45am to close the water, but by then the water had already damaged the lift cars and circuitry panels.(almost 6 ft of water trapped in the lift tunnel 3 & 4)

As of 5.00am today, Lifts 3 & 4 of Mutiara is not usable anymore (pending repairs)

Block C (single Lift) is also water logged but within only 3 feet of water, which means it is serviceable and can be utilized temporarily (pending full check up and repair) for the two towers.

The source of the burst water pipe was Block B1 where ongoing work to reconnect from the temporary poly pipes to the new GI pipes is ongoing. Investigations on the true cause of water bursting are ongoing. The contractor involved has been instructed to submit an incident report a.s.ap.

By 12pm, suction pumps had been sourced by this office and transported to selat by our in- house contractors to drain the water out of the lift tunnels. The required blowers and heaters have also been sourced and will be in Selat by 3pm, latest.

At this hour (2.25pm) the adjusters were invited in and the damage assessment teams were guided by representatives of Dover (lift repair) and me.

We have been advised by the KL headquarters of Dover that the parts and circuitry required will take 10 days time to reach us as they are OEM parts from Japan . I have challenged them to do it within 72 hrs ..

By 4.30 p.m., all debris, mud and earth that was left behind by the water would have been cleared and for all residents a semblance of order would have been achieved.

Overall the critical period / damage control / flooded areas have been contained and within our control, although the office is preparing for the barrage of complaints by residents of the high rise floors and of Block B1 for water resumption (projected to be completed by 6.00pm today) since the water has been put offline earlier in the morning to fix the burst pipe.

More details will be delivered once we receive them.

The VAEA Joint Action Group met on 25 April 2008 on the abovementioned matter and has decided to inform all stratified property owners that they can ignore the Public Notice by the Board of Valuers, Appraisers and Estate Agents on 24 April 2008, which is essentially their interpretation and "view". It is not binding on owners.

We reiterate that All JMBs/MCs are at full liberty to appoint their own managing agents upon terms and conditions to be mutually negotiated and decided upon between the parties concerned.

Please feel free to contact the VAEA Joint Action Group Secretariat for assistance, including legal support, if the Board intervenes in your decisions or takes action against you. Our contact particulars have been provided in our Public Notice dated 14 April 2008.

In Consideration of our Dialogues with the residents in Block B1 of Mutiara Tower, the request for Water disruption (due for re connection to the recently upgraded Main Distribution trunk Line) to be reduced during this busy holiday season has been acknowledged & accepted.

The main water distribution pipes is currently using a temporary By Pass system and it will be reverted to the main line upon completion of the New Year festivities period. This future disruption will be a 2 day water disruption period (Between 9am - 5 pm; weekdays )

Coming Work Schedule & Water Disruptions in Selat Condo

Dear All,

Please be informed that on Tuesday (08\12\2009) a temporary water shutdown will be effected in the B1 Block of Mutiara, Selat Horizon Condominiums between 9.00 am and 5.00pm for upgrading works to the currently rusted and leaking GI pipes. This interruption is due to the bypass pipes created and once the new pipes are inserted, (approx 10 days later) another few hours of water interruptions will again be required to divert water back to the converted main lines.

The inconvenience caused is regretted.

On another issue, in complying with required statutory requirements for Maintenance of the Low Tension Room, (Electrical) the Bi Annual Calibration tests for the LTR was recenty completed by our consultant engineers. The Management Council has been provided the calibration results and the recommended job maintenance report submitted by the Consultants.

The Consulting Engineers have been requested to complete the maintenance work as per their report and we are currently awaiting their quote on costs.

For your info,recently a Letter from the Local Municipality requesting adherence to the structural safety codes of Buildings (compliance) was received by our office. This notice is for buildings above 10 years old to be inspected and declared fit by a qualified Structural Engineer. Selat Horizon Condominiums has been advised to engage a structural Engineer within 30 days to submit the report to the Local Government Body.

The Management Council will be provided with the required firms names and their associated costs for perusal and selection soon.

PS: The annual pool safety and structural inspection (for the certification) will be scheduled for the local water board inspection team by next month.

Security Card Access Update.

Dear All,

Please be informed that the Management Council has instructed this office that effective March 2010 onwards, the current system of security card access ( for car parking priveleges) will be restricted to ONLY 1 card per unit ; with provision to PURCHASE the second card.

As such, to ensure a smooth transition, this office will stop the sales of all security access cards effective immediately for tenants.

Deepavali as explained by:

Spiritual significance
While Deepavali or Divali is popularly known as the "festival of lights", the most significant spiritual meaning is "the awareness of the inner light".

Central to Hindu philosophy is the assertion that there is something beyond the physical body and mind which is pure, infinite, and eternal, called the Atman. Just as we celebrate the birth of our physical being, Deepavali is the celebration of this inner light, in particular the knowing of which outshines all darkness (removes all obstacles and dispels all ignorance), awakening the individual to one's true nature, not as the body, but as the unchanging, infinite, immanent and transcendent reality.

With the realization of the Atman comes universal compassion, love, and the awareness of the oneness of all things (higher knowledge). This brings Ananda (inner joy or peace).

The gunas are the underlying forces or tendencies which one needs to have unaffected, direct relation with in order to find effectiveness and righteousness in life: they are lines of potential and illuminate thought and action, thus the inner meaning of Diwali being the festival of lights.

Deepavali celebrates this through festive fireworks, lights, flowers, sharing of sweets, and worship. While the story behind Dipavali varies from region to region, the essence is the same - to rejoice in the inner light (Atman) or the underlying reality of all things (Brahman).

Hindus have several significant events associated with it:

Return of Rama to Ayodhya:
Deepavali also celebrates the return of Rama, King of Ayodhya, with his wife Sita and brother Lakshmana to Ayodhya after a 14 year exile, and a war in which he killed Ravana. It is believed that the people of Ayodhya lit ghee lamps along the way to light their path in the darkness. Since Ram traveled from South India to his kingdom in North India, he passed through the south earlier. This is the reason why the festival is celebrated a day earlier in South India. Deepavali usually comes 19 or 20 days after Dasara.

The Killing of Narakasura:
Celebrated as Narak Chaturdashi, one day before Deepavali day, it commemorates the killing of Narakasura, an evil demon who created havoc, by Krishna's wife Satyabhama. This happened in the Dwapara Yuga during this time of Krishna's avatar. In another version, the demon was killed by Krishna ( Krishna provokes his wife Satyabhama to kill Narshna defeating Indra: Govardhan Puja is celebrated the day after Deepavali. It is the day Krishna defeated Indra, the deity of thunder and rain. As per the story, Krishna saw huge preparations for the annual offering to Lord Indra and questions his father Nanda about it. He debated with the villagers about what their 'dharma' truly was. They were farmers, they should do their duty and concentrate on farming and protection of their cattle. He continued to say that all human beings should merely do their 'karma', to the best of their ability and not pray for natural phenomenon. The villagers were convinced by Krishna, and did not proceed with the special puja (prayer). Indra was then angered, and flooded the village. Krishna then lifted Mt Govardhan and held it up as protection to his people and cattle from the rain. Indra finally accepted defeat and recognized Krishna as supreme. This aspect of Krishna's life is mostly glossed over,but it set up the basis of the 'karma' philosophy later detailed in the Bhagavat Gita

In Malaysia, Diwali is known as "Hari Deepavali," and is celebrated during the seventh month of the Hindu solar calendar.
It is a federal public holiday throughout Malaysia. In many respects it resembles the traditions followed in the Indian subcontinent.
'Open houses' are held where Hindu Malaysians (Malaysian Tamils) welcome fellow Malaysians of different races and religions to their house for a sumptious meal.
This is a practice unique to Malaysia and shows the goodwill and friendly ties practised by all Malaysians during any festive occasion.

In Singapore, the festival is called "Deepavali", and is a gazetted public holiday. Observed primarily by the minority Indian community ([Tamils]]) , it is typically marked by a light-up in the Little India district. The Hindu Endowment Board of Singapore along with Singapores' government organizes many cultural events around Deepavali time.

Dear All,

Welcome once again to another posting from the Administrators of Selat Horizon Management Corporation. Please find below the current briefings the management council members had looked into:

Breakdown of Quotations for renovations to the GYM/Sauna Toilets were made available for council perusal. Local council has been provided the breakdown on 17/07/2009 for their perusal and Final Instructions.

We have also received part payment of RM 4000++ from our legal advisors TG KOH on the (M04/10) arrears. This was a case where the owners were made bankrupts for non payment. The payments still pending is the sum released by the OA to Grobina’s solicitors. In this case, once the arrears resume the Notice of Demand Level set by Council, a new court action will be initiated against the owners.

Payment on Judgement In Default case no: M05/12 (RM 9818.38) has been also been received from the Legal Firm of Chew Chin Thai. Also, in answer to the letter of complaint sent by owners Rosemary Lee and Chew Chin Thai to the Valuation Board, Malaysia, the Melaka Police Dept, and The Commisioner Of Buildings Dept,(MBMB);-The Lord Mayor in his capacity as the Commissioner of Building had replied to the complainants letter (and hand delivered to us) establishing SHMC Managing Council’s right and privilege in appointing its own Management staff and employees.

Our Legal Advisors has advised the Managing Council on the options available to them on possible action against these harassment as one of them is a government employee and the other is guided by the Bar Council Ethics and Disciplinary council.

With the assistance of Mahajaya’s DGM (Jackie), manager Gunabalan had also secured the payment of RM 27,000.00 from the 11 year old court case initiated against M 12-02 by the previous developers. Council Members was happy to note an end to this acrimonious court case between our two parties.

On another note, Avatar’s Legal Office has written to us on the minimum breakdown of costs for each JID case that they pursue for us. (RM 2734++). We have 6 cases in hand.

Council will also review their visit to Lawyer Kumari for an opinion on her services and costs.

Council also discussed the Complaints Book entries and noted Mdm. Agnes Cheah
(M 04/06) had written in thanking the Office for the assistance and help rendered to her recently in overcoming her problems.

On Operations ;
Maintenance repair issues for 3rd and 4th quarter of 2009 was discussed and instructions to the Manager given.

Selat’s appointed TV contractors have provided a summary of current reception reliability in Mutiara Block for council’s perusal .

Gym Equipment half yearly repairs had been completed in early August 2009.

Pool suction pipe and valve has been found not working at full capacity which resulted in a drop of water quality. Repairs will be starts once the contractors give a quote on repair cost.

Instructions to Tokio-Marine Ins have been delivered on matter of not closing the E & O cover for year 2008 (with regards to writ of summons).

The entire cleaning staff for Selat was changed recently and a new team is in place. No problems have been raised on the new team’s work and their progress will be supervised closely to ensure no routine disruptions.

Activities planned for and completed in August 2009 were as follows:

i. Work monitoring tri annual cleaning process in Selat by contractors
ii Checks on Water Storage tanks, ground pump room, and water- pressure pipes and generator.
iii. Low Tension Room and all Generator Rooms weekly & yearly inspection.
iv. Swimming pool water PH, Alum, Chlorine inspection, Pump / Gen-set room inspection.
v. Sweeping of all Krill-Stones & Plastic & Wood debris in and around Selat Horizon.
vi. Gymnasium inspection, Sauna cleaning and toilet maintenance.
vii. Spot Painting of areas in the Lobby & Common areas.
viii.Checks on all floors DB’s as reported by tenants on lighting failure, especially after the thunderstorm.

Please be informed renovations to the Gymnasium building Toilets have been discussed by the Management Council members, as the facility needs urgent touch up's.

Quotations from contractors have been called & opened and the reply perused by the Managing Council members in the last three meetings.

The received quotes vary from RM 13,800 to RM 23,000. The local council members are now in the Final Selection process whereby the samples and tiles and color schemes will be discussed and selected.

CCTV cameras don't cut crime

It's official! CCTV cameras do not cut crime.

Except possibly theft from cars left in car parks.

I said as much in my book The Rotten State of Britain, published a year ago (watch out for the paperback, coming soon).

But now a major (and expensive) study by the Metropolitan Police has come to the same conclusion. There are about a million CCTV cameras in London, and – industry experts estimate – about 3.8 million in the country as a whole. But only one crime is solved for every 1,000 CCTV cameras. The Met figures show that each case helped by the use of CCTV costs about £20,000 to solve.

The rapid spread of CCTV cameras has gone hand in hand with a massive increase in crime, particularly violent crime. People demand CCTV because it makes them feel safer. Unfortunately it doesn't actually make them safer. All it does is subject them to snooping and abuse.

Local councils had to be told to cut back their snooping on people they suspected of leaving their wheelie-bin lids open, or letting their dogs foul the pavement. Other officials have used cameras to ogle female airport passengers. Given the number of people with access to CCTV images, it can't be long before we find people being blackmailed over them, as has happened in the US. Maybe it's already happened here too.

While CCTV images may give officials a thrill, the Met study confirms that they are utterly useless in prosecuting cases. Often, the images are not clear enough to make an identification that would stand up beyond reasonable doubt.

More often still, the images are not securely stored – so the courts throw them out, on the grounds that they might have been tampered with.

So why do we have CCTV at all? I suspect it's mostly officials covering their backs. If crime occurs and they have done nothing, they will get criticized.

If they put up CCTV, at least they can say they made an effort, even though it didn't work out, as it (almost) never does. And for that, we are compromising our privacy and passing more potential power on to the authorities. Not worth it, I would say – if we ever got so much as a national debate on the subject, which of course we won't.

Golden Corporate Heritage’s RM1.2bil project in Malacca on track

KUALA LUMPUR:

Golden Corporate Heritage Sdn Bhd’s RM1.2bil development to turn parts of Malacca into an Arab City by 2012 is progressing well, said managing director Hesham Fathi.

“The pillar structures are already completed on Pulau Melaka as we are planning for the grand opening by March,” he told StarBiz recently.

The company, a collaboration between Arab and local businessmen, is transforming parts of Malacca city, namely Pulau Melaka, Klebang and Kg Jawa, into an Arab City after the first proposal to build the project in Klang Valley fell through.

The state government has a 10% stake in the project through Chief Minister Inc (CMI).
“We feel that the proposed Arab City in Bukit Bintang was inappropriate because of the surroundings.

When the Chief Minister of Malacca invited us to do the Arab City in that state, the approval was done in just five hours,” Hesham said.

When completed, the RM250mil Arab City project on Pulau Melaka, which is reclaimed land located off the Bandar Hilir coast, will have 240 lots offering products from the Arab world, including 10 restaurants specialising in authentic Middle Eastern cuisines and a museum with genuine Egyptian artefacts.

“We are not going to sell or lease these lots as we are going to operate them by ourselves. The completion of Arab City will create about 850 jobs for the locals,” Hesham said.

Meanwhile, piling works in Klebang will start in three months for the construction of an Arab healthcare city, according to Hesham.

It was reported that the Klebang site, which covers about 4ha and investment of RM700mil, will also involve the construction of a five-star hotel, a water theme park, an aquarium and a floating restaurant.
For the Kg Jawa development, Hesham said the site would see an establishment of 12 Arabic restaurants and coffee shops from different Arabic cultures.

As the site is facing the Malacca river, it would be “tastefully” constructed with Andalusian-styled domes, he said.

“I would like to stress here that the perception of eliminating business people (currently operating) in Kg Jawa and their heritage buildings is not true. What we are going to do is to develop the area and build much better business bazaars for them. By this, we are helping them upgrade their living and income as we are bringing tourists from the Middle East to shop here,” he said.

It was reported that on April 2, Chief Minister Datuk Seri Mohd Ali Rustam visited Kg Jawa and agreed that the historical section of the village would be excluded from the Arab acquisition.
The state had initially intended to acquire the entire village comprising 84 lots and covering 6.34ha but agreed to scale down the project following protests by the MCA.

The past few weeks have been extremely satisfying as we managed to overcome many roofing problems that was giving perennial problems to the involved unit owners for many years.

A couple of leaking units unsolved these past few years,due to the owners being absent from Malaysia have also been solved as Council has taken the initiative to proceed with legal avenues which provides us with much needed collection of revenue to proceed with said repairs.

The Management has also restructured the sytem of MATV within the condominiums properties that now, elements like tempest and wind factors will affect the aerials lesser than before. Under the advice of our Mgmt Council, a retainer fee has also been initiated to ensure that the contractors do quarterly surveys on the MATV System irrespective whether there is problems or not as part of our maintenance update.

Plans are also a foot to put this Condominium on the Minds of more people and draw attention to its Good Living Spaces, beautiful Landscaped Gardens, and friendly and family oriented owners. We are proud to announce, that bar the occasional disturbances of the "THOSE We PREFER NOT NAMED", this condominium is widely received as one of the better managed and value added condo's in Melaka! (The proof is the pudding, my dad used to say! Kalau paham,bagus. Tak faham, tak pe !)

Indeed, it is a sweet beginning for the month which promises of better memories to come!

MELAKA, June 25 (Bernama) -- Melaka's Aerorail Transit System project worth RM1.5 billion is expected to start in the first quarter next year, according to its developer Pyramid Express Sdn Bhd.

Its managing director, Lim Sue Beng, said a total of 26 trains with five compartments each will be offered to serve 10 stations while the development will be carried out in two phases."The whole project is expected to be completed in six years," he told reporters at the initial preview of the project at the lobby of the Majlis Bandaraya Melaka Bersejarah (MBMB) building here Thursday.

Chief Minister Datuk Seri Mohd Ali Rustam was also present at today's event.The aerorail system in Melaka will be built, operated and managed by Pyramid Express Sdn Bhd with the help of the local agent of Aerobus International from Houston, US.

In the development plan are the construction of structure, stations, the aerorail depot, hotel, serviced apartment and others.Lim said the first phase costing RM500 million will see the construction of the route covering 7.8 km in length, seven stations and a depot while the second phase will cost RM1 billion."The second phase will cover another 7.5 km and the building of three stations and the other facilities," he said.

Meanwhile, Mohd Ali said that among the 10 stations identified were the Tun Ali station (town central), Chempaka station, Sentral station, Peringgit station, College station (close to Kolej Yayasan Melaka), MBMB station, MMU station, MITC station and the last station near Zoo Melaka.

The project plan is on the display to the public until Sept 22. Mohd Ali said the people were invited to give their comments, suggestions and any objections so that Melaka is able to provide an efficient public transportation system for its people and visitors.-- BERNAMA

The state government has approved the reclamation of a 72ha site off the Portuguese Settlement for mixed development, Chief Minister Datuk Seri Mohd Ali Rustam said.

He said a private company, Bumi Tabah Sdn Bhd, which is undertaking the reclamation would create six man-made islands that would have hotels, shopping malls and high-end residential apartments. “Malacca can be called Venice of the East once again after completion of the six islands, expected within five years,” Mohd Ali told reporters after presenting presents to children at Portuguese Settlement.

He said there would be road links from the commercial area of Taman Melaka Raya to Tengkera, adding that the state also planned to construct a coastal highway connecting Melaka Raya, Padang Temu, Pertam and the Air Keroh-Merlimau-Jasin highway.

The Chief Minister gave his assurance that the fishermen along the coast would not be affected by the projects, as a new jetty would be built at Klebang beach soon. "The new jetty would serve as a centre for all fishing boats to land their catches," he said.

Bumi Tabah director Joseph Sta Maria said the project would complement the coastal corridor development planned by the state government. "We are investing RM1 bil for the reclamation which is expected to be completed within 18 months together with the creation of the six islands," he said.

The state government plans to introduce a water taxi service along Sungai Melaka and the coastal areas in the state before year-end.
Chief Minister Datuk Seri Mohd Ali Rustam said the taxis would provide service from Melaka Sentral to the Dataran Sungai Melaka and from the Sungai Melaka estuary to the Sungai Linggi Jetty and the Sungai Rambai Jetty.
He said this at the launching of the Pesta Sungai Melaka ceremony by Malacca Yang di-Pertua Negri Tun Mohd Khalil Yaakob here last night.
Mohd Ali said the proposal to introduce the taxis, like the ones used in Britain and New Zealand, was to diversify activities along Sungai Melaka.
He said so far, the Melaka River and Beach Development Corp provided 25 passenger boats for the Melaka river cruise for people to enjoy the scenery along the 4.5km stretch between Tanah Rempah Ratus and the river mouth.

Dear All,
A freak wind storm early this morning displaced and broke some portions of the lower zinc roofs and upper floor tiles plus caused damage to the pool area.
(as attached pictures 1-6.)

This is the second wind and tempest caused damage in the condo within the last 60 days.
Our maintenance man is on the ground limiting further damage to the condo and clearing up the strewn garbage and debris.
Contractors will be summoned to expedite repairs immediately.

Happy Vesak Day to all Buddhist!

On this ceremonious and faith inspiring day, Buddhists around the world will be contemplating on the Buddha, as a mark of respect and adoration.

Vesak day is celebrated by Buddhist from all over the world to commemorate the birth and enlightenment of Guatama Buddha.

It was this strong belief in peace amongst men and goodwill to all that has helped create a better world for most believers, for apart from traditions like prayers, chants - practicing compassion and goodwill (Dharma) are equally important - partly by observing individual restraint through the cotrol of desires ie having vegetarian meals and practising the act of giving to the poor / giving gifts to the needy or old folks homes are also commonly practice.

One of the finer tenets of Buddhism is learning the act of forgiving. So simple .....yet so difficult !

This writer, for one, belief that the true potrayal of one's self (chracter) is self evident in the way we treat our enemies. Many a wandering thought creeps up and remain in our heads when we are angry and resentful of some perceived bad deeds done against us. I've noticed that though the actual incident may be fleeting / happen some time ago, but by constantly remembering and brooding over that incident we will eventually make a mountain out of a mole hill and later elongate that process longer by planning sweet revenge!

This will eventually make one self very resentful and angry all the time. But funnily , we seem to enjoy feeling Bad !

This is where the act of forgiving becomes harder than one might imagine.

Hopefully, this day of observance will help is to re ignite our way to find inner truth.

The Malacca High Court has at this date not given us the next hearing date but I wish to state here that this decision to proceed will be appealed, for us to study the grounds for Judgment.
This notice is sent to all of you to clarify that the current Management Council has heard of rumor mongering that seems to imply Judgment has been made in this case when the truth is that the case has not even begun!
Also, please be reminded that the ONLY legal Maintenance and Sinking Fund Account for the remittance of monthly maintenance payments is with the Public Bank account in Jalan Tengkera, Melaka and not any other.
In short, allow me to emphasize that recent news of our loss is greatly exaggerated.

MALAYSIA is to open some sectors in the service sector of its economy to foreign investors without requiring them to have domestic companies as stakeholders, the country’s prime minister said today.
The areas that will be freed up are in Health, Tourism, Transport, Business Services and Computer Related Businesses and cover 27 subsectors of the services economy, Prime Minister Datuk Seri Najib Razak told a press conference.

In addition up to five foreign law firms will be allowed to enter if they work in Islamic finance, a sector Malaysia is keen to boost.Other finance areas are not being opened up further under the plans announced on Wednesday and air travel, utilities, the distributive trades are among the areas that will not be opened up under the current round. - Reuters

SH March Meeting Minutes

1 Welcoming Address:

1.1 Meeting was called to order at 2.15 p.m. and MA, Gunabalan welcome the 4th Management councilors present.

1.2 MA, Gunabalan also welcome Parcel Owner, Mr. Robert Lim to the council meeting. He then proceeded to introduce our Cleaning contractor, Mr. Richard.

2 . Meeting Minutes :
MA, Gunabalan called for previous meeting minutes to be confirmed. As there were no queries raised, the meeting minutes #9 chaired by 3rd Management Council is hereby confirmed.

3 Legal Matters;
3.1 MA, Gunabalan introduces Ms Loh from TG Koh’s office to all council members present.
3.2 Ms Loh then took over from MA, Gunabalan and highlighted on the case pending at hand. On the case of (M04/10; Ms Loh informed that she had contacted Adillah & Nordin and shall continue to write to Adillah & Nordin for their response to our claim. Ms Loh had initially advised council to get a court order to seal the unit but upon further discussion, councilors present requested for Ms Loh to write and pursue the matter with Adilah & Nordin constantly.

3.3 As for (M12/02) case, Ms Loh informed that the owner had contacted her. Ms Loh then requested Nalini to forward the breakdown of monies owed so that she could further discuss with Susana on the payment. Nalini will forward the required information latest next Tuesday.

3.4 On the matter of monies owed by (M14/01), MA, Gunabalan informed that as at meeting day, the owner has yet to contact our office and proposed to council on next step to be taken which is to send him an Notice of Demand (NOD) through the lawyers. Councilors present agreed to his proposal. Ms. Loh noted.

4 Administration:
4.1 MA, Gunabalan introduces Mr. Richard from Whitehorse (our cleaning contractor) to councils present as there were some clarifications required on the MA’s alleged business relationship with Mr. Richard.
Chairman, John Zing put forth an observation whereby it has been brought to council attention by a 3rd party that Mr. Richard and MA, Gunabalan are partners and view this as conflict of interest should such observation be deemed true.
Mr. Richard clarified that MA, Gunabalan is not his business partner and shall provide his company’s profile as proof.
Councilor, HT Lim said that he heard hearsay that Mr. Richard had mentioned to some potential business contact that he is a business partner of MA, Gunabalan. Mr. Richard denied mentioning such arrangement.
Councilor, Tai Chai Kun stressed that as long as the company profile provided does not carries MA, Gunabalan’s name, it justifies itself as nothing more than mere rumor mongering.
4.2 MA, Gunabalan highlighted that the police force has started investigating on matters arising from the complaint against the illegal council and that he had been summoned to give his statement.
Secretary, Michael Banerji proposed to let the police department do their job and just be patient and observe the outcome later.
4.3 MA, Gunabalan informed that he has been in contact with Ms Jackie, General Manager of Mahajaya to released monies due to the Maintenance & Sinking fund for the replacement of deposits made to relevant authority bodies amounting to RM6, 970.00 which he will be following up regularly.
4.4 Secretary, Michael Banerji and Treasurer, Ben Soon agreed that both had verified and passed the documents required for next court mentioned to Avatar (scheduled for April 2009).
4.5 There were some mixed opinions on the proposal received from an ICT company to rent SH rooftop for leasing rights to their communication tower transmission. Treasurer, Ben Soon is concerned on the radio wave that might cause cancer. Secretary, Michael Banerji was more concern for our TV reception and lightning safety as he is not so sure of the hazard risk. After much deliberation, all councils agreed not to allow the ICT’ company to rent SH rooftop.

5 Operation:
5.1Secretary, Michael Banerji stressed that AstroDisc fixture must be controlled / aligned, and debris from any renovation work must be cleared by the contractors themselves and not our cleaners.
Councilor, HT Lim also highlighted that all changes to façade must be approved by the office.
MA, Gunabalan noted the matter at hand and shall control on the placement of fixtures. As for the cleaning of debris, he mentioned that if at anytime the cleaners are caught doing so during working hours, action shall be taken against them. However, he notes that the cleaners do take up additional work after the working hours, same goes for Zul, the office maintenance person.
Councilor, Tan Chai Kun explained that at times when his unit needs some job to be done, Zul will only assist after his working hours. During the working hours, Zul is very clear of the parameter of his job.

5.2 MA has reported previously the TV receptions in SH, even for Malaysia channel is affected and often not receiving stations well. Work has been and is currently been done to rectify the situation. Councilor HT,has requested the antenna, Cable-wires leading to the antenna & each individual unit be checked and if necessary quotations be called for it’s change. MA, Gunabalan highlighted that the central antenna / cable up to the MATV juncture box has formerly been tested okay. Problem could be from the MATV junction box to the house TV.

5.2 Bird shit is currently been clean every 3 months but Councilor, William Soh request office to do the cleaning every 2 weeks and at the same time to get rid of the bird nest. He felt that the hazard from the bird shit must be eliminated. Councilor, HT Lim explained that each month when he comes for meeting, he will surely clean his balcony of bird shit as office can only do general cleaning.
5.3 On the subject of security guards, it is agreed that all security patrolling should be on an hourly basis. MA, Gunabalan to source for clocking system quote.

6 Accounts:
6.1The income received and spent for the month of Jan & Feb 2009 was tabled and closed.

7 MA contract:
7.1 The council took some time to deliberate on MA contract for 2009 and after much discussion, unanimously agreed to extend Balmic Management Services and Enterprise contract to another year.

The following requests were made by council members present, details as below: -

(a) A complaint log to record parcel owners complaint and action taken, the record to be made available during monthly meeting.

(b) To have a fixed asset register and all scrap or written off assets is to be table in monthly council meeting.

(c) To prepare a Preventive Maintenance & Inspection schedule (currently available is only maintenance plan, therefore it will be best if we could inspect and clearly identify maintenance work requires either to be done internally or outsource and tie the works done into a preventive maintenance and inspection schedule).

KL revamps 'second home' programme

KUALA LUMPUR, March 24 - Malaysia plans to ramp up its second home programme to derive more economic spin-offs, noticeably in the area of investments and real estate, where nearly RM5 billion of the latter were sold to foreign applicants over the past five years.

Since 2004, Malaysia My Second Home or MM2H participants have acquired 510 residential units worth some RM4.72 billion, and 1,452 locally assembled vehicles, Tourism Minister Azalina Othman Said said yesterday at an event to re-brand the programme.

Kuala Lumpur believes the programme momentum is picking up and appears to have decided the long-stay initiative should not be confined to its 'tourism value', but should now be better leveraged for the economic benefits.As such, its re-branding of the MM2H includes positioning it 'as an economic and investment generating initiative to attract high net-worth individuals to set up businesses or joint-ventures with local entrepreneurs'.

Participants can now 'invest actively in Malaysia' and those above 50 years old can work in critical sectors of the economy where locals lack the expertise or experience - subject to the approval of an expatriate committee.

The areas were left unspecified.

Other 'key improvements' include giving foreign spouses married to Malaysian citizens the option of staying in the country under the programme.

Approved participants get a 10-year social visit pass.

Malaysia appears to be making it easier for skilled and wealthy foreign nationals to obtain permanent residency because of the economic slump and competition from other markets.
The government anticipates foreign direct investments could plunge by half this year and its property sector, like most, has weakened as investors cash out or wait on the sidelines for the recovery.

Unlike more vibrant markets in the region, Kuala Lumpur also lacks a big pool of expatriates to occupy the many apartments coming up in the city.

To address some of these issues and accelerate the change to a knowledge economy, the government recently announced it would offer permanent resident status to high net-worth individuals that bring more than US$2 million (RM7.2 million) into the country for investments or savings.

The same consideration would be made for 'highly skilled foreign professionals'.
The financial requirements for MM2H applicants are lower. Those below 50-years old are required to show proof of liquid assets worth at least RM500,000, while those older than 50 must have a minimum RM350,000.

In the main, the MM2H has attracted retirees, many drawn by the lower cost of living, food and English-speaking population.
Given the growing retiree population in Japan, Korea, Taiwan, US, Europe and China, Ms Azalina said the programme would be intensified in some of these source countries.

A total of 12,566 foreign applicants have been approved as at the end of last year. China topped the list with 2,231 participants. Bangladesh was second, followed by the UK, Japan and Singapore (710 applicants).

Last Saturday (21/03/2009) the new SHMC Management Council met to discuss the operational schedules and obligations of condo maintenance with guests in attendance (Mr. RoberT Lim & Mr. Richard Young)
Prior to the afternoon meeting, a Staff Appreciation Lunch was also conducted for the condo maintenace and operational workers. This yearly affair also saw the current management council members pooling their financial resources to accord the workers "Ang Pows" for their loyalty and hard work through out 2008.

The contributions of Mr & Mrs. John Zing (M04/12), Mr & Mrs. Lim Heng Toh (P02/04) & Mr & Mrs. Michael Tan (M03/05) is hereby recorded and appreciated by the Management Office of Selat Horizon Condominiums on behalf of all staff -recepients and owners.

We are priveleged and honored to have in our midst such luminaries,who year after year generously accord for the condominium staffs their time, effort and considerations.

· For the past 10 months, this writer has been conditioning himself for the advent of the new order that is slowly but undoubtedly unfolding itself in all major currencies and economies worldwide,Malaysia not withstanding.
· Like it or not, dear readers, the Old System or Way of Life is unraveling and we are front seat witnesses to the Changes taking place.
· In some First World countries like the US, Germany, Britain, Sweden, and in others like Argentina, Singapore, Japan & Korea we are seeing with increasing alarm the declines in the net worth of the average family man and their losses sustained by bad financial acuity.

· Take for example this simple analogy: If down the road in the next 10 to 12 months, a small time SME owner or worker in Malaysia lost his life’s savings in the stock market/ investment markets, and due to existing structural format ,he is not favored in his own country-(NEP); he cannot find work, loans taken overburden him, and his wife eventually divorces him, THEN, it will be all his fault because he has failed to receive the requisite training to conform to the “new market conditions” as tabled in the new stimulus plan by the Govt. Right?

HuMBuG!

· Too often, people permit their lives to be conditioned and ruled, and sometimes ruined by man-made systems that the entitlement-minded financial and political elites have forged to retain their privileged status.
· This individual would have been conditioned to equate man-made systems with natural disasters like earthquakes or floods. Part of this thinking is a testament to the resounding success of a ubiquitous “birth-to-death” urbanization campaigns that have convinced people to accept money and capitalism as a “natural system” -a premise that both Adam Smith and Thomas Malthus shared.
· Once people accept that premise, and they aspire to upward mobility possible only within the system, they never ever consider working class consciousness or any other “agricultural alternatives” for to do so is to demean their own self-image.

· The current credit economy / system make possible a lack of ambition for individuals to term themselves as successes.

How many ads are there online, in newspapers, etc., about “assistant manager” in everything from office clerical positions to fast food jobs, when in reality those are low-paying jobs veiled by a “status title” people appreciate more than income? · After all, the “real worth” of the individual was “creditworthiness” bundled as part of net worth, thereby giving the illusion to a large percentage of people that they were part of capitalism’s success.

· Class-consciousness is the enemy of the financial and political elites that constantly inculcate the idea that “all of us must work together and sacrifice” for the greater good, when in fact the “greater good” is largely the domain of the elites. · As the proletarization of the middle class become more apparent in the coming months, the current global crisis will evolve into a middle class crisis of alienation, stratification, and erratic class/status identity.

· Additionally, there will be the increasingly prohibitive costs of medicine, housing & higher education, especially good graduate school and not the crap currently out there, that will be out of reach for a larger percentage of people in the next decade and possibly the next half century. Good Lord, did any one take a look at what the second stimulus plan encapsulates? There’s one stimulus plan that says “Graduate Re- Training”!! · I do not want to go into a tirade over that, but suffice to say, please look into a dictionary the meaning of the word ‘Graduate’ and then tell me what a oxymoron retraining them is!

· At the same time, there will be fewer positions available for the college and SPM educated population that they will have to be highly mobile not only within their own country but also regionally & internationally and must accept jobs unrelated to their college degree–a phenomenon that has been growing in the past decade.

· Through this all, society and families will become increasingly polarized and likely to remain so in the years ahead because of a lack of capital accumulation in a credit-tight, creative unfriendly environment.

· Only those in political position and financial acumen will continue to co-opt (infuse) and grow whereas the majority middle class and working class and their children can only aspire and dream to upward mobility and lifestyle, which should be a birth right in this God given earth!
· That is what Karl Marx wrote more than 100 years ago and he termed it the proletariasation of Society for the privileged few. · The above tirade is not meant to radicalize or color your views of life but is unfortunately the Facts of life as I see it.

Malacca gets nod for RM65m runway extension

The Malacca state government has received the green light from the federal government to extend the runway at Batu Berendam Airport, which is slated for completion in six months.

Chief Minister Datuk Seri Mohd Ali Mohd Rustam said that the extension at the airport, which will be renamed Malacca International Airport, will cost RM65 million.The extension is to accommodate larger carriers like Boeing B737 and Airbus A320, in line with its goal of making the historical state a top tourist destination.

"The runway will be extended to 2,200m from 1,800m now. It will cost RM65 million and the state will take a loan from the federal government for this," Mohd Ali said.

This is in addition to the RM135 million grant given to renovate and refurbish the airport, which is operated by Malaysia Airports Holdings Bhd.Mohd Ali said budget carrier AirAsia has indicated that it will fly to three destinations in Sumatra, Indonesia, namely Pekan Baru, Bukit Tinggi and Medan, from Malacca, once the runway is ready.

"After that, AirAsia plans to fly to Penang and Langkawi and a year after that to Jakarta, Palembang, Balik Papan and Kuching (from Malacca)," he said after witnessing an agreement-signing ceremony between Casa del Rio (M) Sdn Bhd and Bank Pembangunan Malaysia Bhd, and Sin Seong Hin Sdn Bhd.

"Firefly will also be coming in. We now only have Riau Airlines (operating at the airport)," he said, adding that he hopes other charter flights will also operate out of Malacca International Airport.

Mohd Ali said the state recorded a total of 7.2 million tourists last year, of which 6 million were domestic tourists. In the first two months of this year, Malacca has already welcomed 600,000 visitors.

Bank Negara Malaysia Raids Walton International Property Group (M) Sdn Bhd

On 5 March 2009, Bank Negara Malaysia raided Walton International Property Group (M) Sdn Bhd under the Exchange Control Act (ECA) 1953. The raids were simultaneously conducted at the premises of the company in Kuala Lumpur (W. Persekutuan), Kota Kinabalu (Sabah) and Kuching ( Sarawak ) following complaints received from members of the public. Relevant documents of the company were seized for purpose of the investigation.

Members of the public are advised to be cautious of this type of land banking schemes promoted by the company. Any elements of deposit-taking activities and public offerings such as ‘interest schemes' or investment in real estates schemes (better known as ‘real estate investment trusts' - REITs) should be referred to the appropriate authorities such as Bank Negara Malaysia, Suruhanjaya Syarikat Malaysia and Suruhanjaya Sekuriti.

Members of the public are also advised to use lawful remittance channels when making payment or sending money overseas. MINUTES OF 4TH ANNUAL GENERAL MEETING
held on 21st February 2009 at Selat Horizon Resource Centre

Mr. Gunabalan being the Manager of SHMC and who was appointed by the 3rd Management Council as a Sergeant At-Arm called for all attendees to take their seat and called the meeting to order at 2.20 p.m.

He then called for a Meeting Chairman to be appointed from the floor. Mr. Lim Heng Toh (P02-04) proposed Mr. Robert Lim (P08-02) to be appointed as Meeting Chairman and his proposal was seconded by Mr. John Zing (M04-12).

Mr. Robert Lim (P08-02) accepted his appointment as the Meeting Chairman and thanked everyone present for their attendance to the 4th Annual General Meeting of Selat Horizon Condominium Management Corporation. He then proceeded with the meeting proper by calling for 2 volunteer scrutinizers from the floor to assist him in the meeting proper.

Mr. Seng Chong Roo (M06-12) and Mr. Teo Chwee Guan (M03-08) volunteered themselves as scrutinizers.

Meeting Chairman, Mr. Robert Lim (P08-02) then asked for quorum status for the AGM. Mr. Lim Heng Toh (P02-04) being the assignee to count and verify the attendance, produced his report for Mr. Robert Lim to read out to all parcel owners present. As Below:

As such, Meeting Chairman, Mr. Robert Lim (P08-02) confirmed that the quorum required for the AGM meeting was met and will proceed as planned.

At this juncture, a gentleman interrupted the Meeting Chairman, Mr. Robert Lim (P08-02) to enquire about the total paid up parcel owners. Meeting Chairman, Mr. Robert Lim (P08-02) requested the gentleman concerned to introduce himself to all attendees. The gentleman then introduced himself as Mr. Chew Chin Tai (M07-12) and forwarded his question once again.

At this juncture, Mr. Tan Geok Chua (M04-08) questioned whether Mr. Chew Chin Tai (M07-12) had registered himself to participate in the AGM. To answer his question, Mr. Chew Chin Tai (M07-12) said “No, he has not.”

Mr. Tan Geok Chua (M04-08) then asked Meeting Chairman, Mr. Robert Lim (P08-02) to ignore the question raised and to proceed according to agenda. Mr. Chew Chin Tai (M07-12) then informed that he would like to register himself and was allowed to do so.

After registering himself, Mr. Chew Chin Tai (M07-12) then interrupted the Meeting Chairman, Mr. Robert Lim (P08-02) once again to enquire about the numbers for total paid up owners. On this matter, Meeting Chairman, Mr. Robert Lim (P08-02) requested Mr. Chew Chin Tai (M07-12) to be patience and wait for his turn to speak and continue with the meeting agenda.

The following agenda was presented and minutes as below: -

1.0 3rd Council Annual Report

Council member, John Zing (M04-12) thanks all parcel owners present for taking the time to attend the 4th AGM. He highlighted that the 4th meeting agenda and annual report was sent out to all parcel owners and hope that all parcel owners had taken the time to read and will answer any question raised, if any.

As there were no questions raised, he takes the opportunity to thank his fellow council members and on behalf of the councilors give thanks to all unit owners for their support to the MC throughout their term as SHMC Council members.

2.0 Confirmation and adoption of 3rd Annual General Meeting minutes

Meeting Chairman, Mr. Robert Lim (P08-02) then calls for confirmation and adoption of the 3rd AGM minutes.

Mr. Seng Chong Roo (M06-12) proposed to confirm and adopt the 3rd AGM minutes. Mr. Wee Fui Twee (M05-01) seconded Mr. Seng Chong Roo (M06-12) proposal.

Meeting Chairman, Mr. Robert Lim (P08-02) confirmed adoption of the 3rd AGM minutes.

3.0 Treasurer Report for Financial Year 2008
– To adopt and receive

Mr. Ben Soon (M01-12) highlighted that the financial report was sent out together with the meeting agenda and shall answer any question raised, if any from the floor.

As there were no questioned raised, Mr. Tan Geok Chua (M04-08) proposed for the Financial Report for Year 2008 to be adopted and received. Mr. Teo Chwee Guan (M03-08) seconded Mr. Tan Geok Chua (M04-08) proposal.

Meeting Chairman, Mr. Robert Lim (P08-02) confirmed the adoption of the Financial Report for Year 2008.

4.0 To decide whether to increase insurance for fire beyond RM31 million

Meeting Chairman, Mr. Robert Lim (P08-02) informed all parcel owners present that there is a resolution received on matter relating to increase insurance for fire beyond RM31 million and that it will be table and discuss under resolution received.

5.0 To decide whether to confirm or vary any amounts determined as contributions to the Management and Sinking Funds as per Strata Title Act 1985.

Meeting Chairman, Mr. Robert Lim (P08-02) called for the above mentioned subject to be tabled.

Mr. Michael Banerji (M09-10) proposed for the amount currently contributed to Management and Sinking fund to remain. Mr. Lim Heng Toh (P02-04) seconded Mr. Michael Banerji (M09-10) proposal.

Meeting Chairman, Mr. Robert Lim (P08-02) confirmed that the amount currently contributed to Management and Sinking fund shall remain.

6.0 To decide whether to amend, add or repeal the By-Laws in force for Selat Horizon Condominiums

Meeting Chairman, Mr. Robert Lim (P08-02) informed all parcel owners present that there is a resolution received on matter relating to the above mentioned subject and will table and discuss the matter under resolution received.

7.0 Resolutions Proposed

7.1 Meeting Chairman, Mr. Robert Lim (P08-02) informed all parcel owners present that there were six (6) resolutions received and he will put forth each resolutions to be table: -

Resolution # 1

1. To set RM20,000.00 as maximum amount MC is allowed to spend per project.

Decision
It was unanimously agreed that maximum amount MC is allowed to spend per project is set at RM20,000.00.

2. Approval of insurance coverage for MC members against claim by court or other legal bodies.

For this resolution, Mr. Michael Banerji (M09-10) pointed out that parcel owners are sitting in as MC after being nominated and as such should be protected against claim by court or other legal bodies for work done on a voluntary basis for the betterment of the property.

Decision
It was unanimously agreed and approved that MC members should be given insurance coverage against claim by court or other legal bodies.

3. Management Council to initiate a position for Chairman, Secretary and Treasurer.

For this resolution, Mr. Robert Lim (P08-02) explained that in a corporation, there should be proper establishment of administrative personnel to lead and advised that the motion be supported and put into Selat Horizon Condominium By-law.

Decision
It was unanimously agreed a position for Chairman, Secretary and Treasurer be established and put forth into the Selat Horizon Condominium By-law.

4. Approval of expenditure for council meeting in Singapore for the benefits of Singapore owners up to twice a year (for office expenditures only)

For this resolution, Mr. Mohana Krishnan, representative of the COB department enquired on the purpose of having meeting in Singapore and whether local owners are allowed to attend such meeting.

Mr. Michael Banerji (M09-10) explained that it was done for the convenience of owners who are unable to meet the MC in Melaka. He further mentioned that the cost incurred is only for administrative cost which is for the office personnel and not for MC.

Mr. Lim Heng Toh (P02-04) further explained that all local owners are encouraged to meet with MC every month prior to council meetings. If a local owner want to meet with Singapore owner during such trip, they are also invited but at their own expenses.

Mrs. Pek (M05-06) explained that it is for the benefit for the owner and it is also beneficial for arrear collection as she personally uses that opportunity to clear arrears.

Decision
It was unanimously agreed that MC can meet Singapore owners up to twice a year.

5. To consider and if deemed fit, to increase the insurance coverage to RM42 million.

For this resolution, Mr. Mohana Krishnan, representative of the COB department explained the differences in valuation on property and put forth his view on the insurance increased for Selat Horizon Condominium.

Mr. Chew Chin Tai (M07-12) concurred and explained on the current auction prices in Selat Horizon Condominium which is at RM70,000.00 for a unit and therefore does not require such coverage.

Mr. Robert Lim (P08-02) pointed out that Mr. Chew Chin Tai (M07-12) should not compare auction price in order to determine the insurance coverage as it varies for Singapore owners since they have to buy above local purchase prices.

Mr. Anthony Chua (M06-01) then stood up to say that he agrees with the replacement value as submitted.

Decision
It was unanimously agreed to increase the insurance coverage to RM42 million.

6. To approve a budget of RM100,000.00 to be spend in the proceeding year for the following jobs: -
(a) Repair of pool deck
(b) Changing room
(c) Barb wire to perimeter wall and
(d) Water piping and distribution changes

Mr. Michael Banerji (M09-10) explained that the above jobs are deemed necessary and required immediate attention. Mr. Michael Banerji (M09-10) further informed that the council will only proceed with this expenditure once it is satisfied all payment can be met adequately. Mr. John Zing (M04-12) read out the quotes received for each job which totaled to RM100,000.00. and further highlighted that the changing room condition has deteriorated.

Decision
It was unanimously agreed that a budget of RM100,000.00 be approved for the above said jobs.

Meeting Chairman, Mr. Robert Lim (P08-02) thanked all proprietors for their participation and approval.

8.0 Election of Management Council Members

It was unanimously agreed by all present that the above nominees are to be recognized as 4th Management Council members for Year 2009-2010.

9.0 Any Other Business

9.1 Mr. Chew Chin Tai (M07-12) requested for the listing of eligible owners. Meeting Chairman, Mr. Robert Lim (P08-02) requested him to meet with the new Management Council for the record.

9.2 Mrs. Tan Geok Chua (M04-08) wanted to know about the land next to Selat Horizon Condominium which has been leveled and what kind of development is to take place. On this matter, Mr. Mohana Krishnan, representative of the COB department suggested that the office could call, do a land search and check with the town planning council on development that is to take place.

9.3 Madam Rosemary Lee of M01-06 requested for an opportunity to voice her grouses.

9.4 Mr. Mohana Krishnan, representative of the COB department also took the opportunity to address the floor. He advises that all matters pertaining to Selat Horizon Condominium should be discussed and addressed accordingly rather than publicizing unnecessarily. He also asked Mr. Chew Chin Tai (M07-12) for his reason of his grouses and advised proprietors to live within the community spirit.

10.0 Adjournment

We are pleased to inform you that the 4th Annual General Meeting

of the Selat Horizon Management Corporation will be held on :

Saturday, 21st FEBRUARY 2009 @ 2:00 p.m,

Venue at the: Selat Horizon Resource Room.

The SH Corporations’ Managing Council is currently in the process of preparing for this Annual General Meeting and would like to highlight the following: -

1. Quorum: If no quorum of Proprietors is present at the 1st call to meeting on the 21st Feb 2009 (after half an hour from the appointed time for meeting), another meeting will be held at the same venue and time one week later and whom-so-ever then present shall represent the entire required quorum for the 4th AGM.

2. Proxy: Proprietors who are unable to attend the 4th AGM for any reason and wish to appoint a representative may do so by using the proxy form . All proxy form must reach the Selat Horizon Management Corporation Office not later than 2.00 p.m. on 19th Feb 2009 (i.e. 48 hours before the commencement of the AGM).

3. Resolutions: Proprietors who wish to put forward any motions for consideration at the 3rd AGM need to submit their resolutions to the Managing Agent, c/o the Management Office latest by 14th February 2009. Please use the form that has been provided.

4. Councils Nomination: Nominees nominated must accept the nomination by duly signing on the acceptance column on the nomination form which has been mailed to all owners.

5. Eligibility to Vote: Proprietors are entitled to vote in respect of any proposal submitted at a AGM only if:

(a) the Owners/Proprietors is the proprietors or co- proprietor as shown on the Strata Roll
and

(b) have paid all monies and maintenance fees outstanding (including interest charges) for month ending 31st December 2008.

On Legal Matter
Manager, Gunabalan brought everyone’s attention to the court case against the individual elected Mgmt Council members that was supposed to be mentioned in November has been postponed to FEB 23, 2009.

Council also highlighted that the reply to Bar Council Disciplinary Board on Chew Chin Tai’s rebuttal has been done.

Manager, Gunabalan notified all councils present on the proceeding bankruptcy case against (M04-10).

As for the matter of arrear / defaulter list, Manager, Gunabalan is asked to monitor closely the listings and take proper measures as discussed and agreed upon previously.
MA, Gunabalan informed all councils present that the (M04/10) case has been cleared of the bankruptcy charges imposed by Grobina but we have yet to receive any monies as Grobina has yet to approve the release on monies to us.

Appointed lawyer, Koh has written to Grobina to explain their rational and as of meeting day, we have yet to receive any reply.

Councils present noted the next action to be taken against (M06/03) which is due as we have obtained Judgment in Default, the unit will be seal and movable items to be auction off.

Councils present agreed to suggestions raised which is to get Appointed lawyer, Koh to request for unit M05/12 belongings to be sealed and movable items to be auction off.

As for our written request for (M08/02) to provide the office a repayment schedule, we have yet to receive any reply. However, he is paying his monthly billings with interest captured.

During the previous months meetings Manager, Gunabalan brought councils attention to the security matters at hand. Councilors, however pointed out that even if we were to bring in higher level of security guards (with higher cost), we should first layout our guidelines and specifications to ensure safety of residents.

After much deliberation, it is concluded that we will continue with current security levels with the following specifications & requirements: -

Security guards should be below 55 years of age,
To visibly increase more hourly patrols and
Patrol with checklist and report.

On another matter, (P01-02 ), Manager Gunabalan reports that scheduler payments are now received monthly and in order. Gratitude and Thanks is noted to councilor John Zing in acting for and on behalf of Selat Horizon Condo in receiving the payments in S’pore and delivering it to us in Melaka.

Financial Accounts:
The income received and spent for the month of December 2008 was tabled and closed. Councilors asked for clarification on major expenditure and MA, Gunabalan clarified and provided the relevant information to such expenditure. Accounts for 2008 will be closed and sent for audit by this month.

Activities planned for and completed in December 2008 were as follows:

i. Monthly Water Meter reading.

ii. Checks on Water Storage tanks, ground pump room, and water- pressure pipes and generator.

iii. Low Tension Room and all Generator Rooms weekly & yearly inspection.

iv. Swimming pool water PH, Alum, Chlorine inspection, Pump / Gen-set room inspection.

v. Sweeping of all Krill-Stones & Plastic & Wood debris in and around Selat Horizon.

vi. Gymnasium inspection, Sauna cleaning and toilet maintenance.

vii. Spot Painting of areas in the Lobby & Common areas.

viii. Checks on all floors DB’s as reported by tenants on lighting failure, especially after the thunderstorm.

In a recession, consumers become value oriented, distributors are concerned about cash, and employees worry about their jobs. But a downturn is no time to stop spending on marketing.

The key, says professor John Quelch, is to understand how the needs of your customers and partners change, and adapt your strategies to the new reality. Key concepts include:
· Brands that increase advertising during a downturn can improve market share and return on investment.
· Early-buy allowances, extended financing, and generous return policies motivate distributors to stock your full product line.
· In tough times, price cuts attract more consumer support than promotions.
· CEOs must spend more time with customers and employees.

The Signs of an imminent recession are all around us. The spillover from the subprime mortgage crisis is weakening both consumer confidence and the consumer spending—much of it on credit—that has been buoying the U.S. economy.
Companies should bear eight factors in mind when making their marketing plans for 2008 and 2009:

1. Research the customer.

Instead of cutting the market research budget, you need to know more than ever how consumers are redefining value and responding to the recession. Price elasticity curves are changing. Consumers take more time searching for durable goods and negotiate harder at the point of sale. They are more willing to postpone purchases, trade down, or buy less. Must-have features of yesterday are today's can-live-withouts. Trusted brands are especially valued and they can still launch new products successfully, but interest in new brands and new categories fades. Conspicuous consumption becomes less prevalent.

2. Focus on family values.

When economic hard times loom, we tend to retreat to our village. Look for cozy hearth-and-home family scenes in advertising to replace images of extreme sports, adventure, and rugged individualism. Zany humor and appeals on the basis of fear are out. Greeting card sales, telephone use, and discretionary spending on home furnishings and home entertainment will hold up well, as uncertainty prompts us to stay at home but also stay connected with family and friends.
Now may be the time to drop your weaker distributors and upgrade your sales force.

3. Maintain marketing spending.

This is not the time to cut advertising. It is well documented that brands that increase advertising during a recession, when competitors are cutting back, can improve market share and return on investment at lower cost than during good economic times. Uncertain consumers need the reassurance of known brands, and more consumers at home watching television can deliver higher than expected audiences at lower cost-per-thousand impressions. Brands with deep pockets may be able to negotiate favorable advertising rates and lock them in for several years. If you have to cut marketing spending, try to maintain the frequency of advertisements by shifting from 30-second to 15-second advertisements, substituting radio for television advertising, or increasing the use of direct marketing, which gives more immediate sales impact.
4. Adjust product portfolios. Marketers must reforecast demand for each item in their product lines as consumers’ trade down to models that stress good value, such as cars with fewer options. Tough times favor multi-purpose goods over specialized products, and weaker items in product lines should be pruned. In grocery-products categories, good-quality own-brands gain at the expense of national brands. Industrial customers prefer to see products and services unbundled and priced separately. Gimmicks are out; reliability, durability, safety, and performance are in. New products, especially those that address the new consumer reality and thereby put pressure on competitors, should still be introduced, but advertising should stress superior price performance, not corporate image.

5. Support distributors.

In uncertain times, no one wants to tie up working capital in excess inventories. Early-buy allowances, extended financing and generous return policies motivate distributors to stock your full product line. This is particularly true with unproven new products. Be careful about expanding distribution to lower-priced channels; doing so can jeopardize existing relationships and your brand image. However, now may be the time to drop your weaker distributors and upgrade your sales force by recruiting those sacked by other companies.

6. Adjust pricing tactics.

Customers will be shopping around for the best deals. You do not necessarily have to cut list prices, but you may need to offer more temporary price promotions, reduce thresholds for quantity discounts, extend credit to long-standing customers, and price smaller pack sizes more aggressively. In tough times, price cuts attract more consumer support than promotions such as sweepstakes and mail-in offers.

7. Stress market share.

In all but a few technology categories where growth prospects are strong, companies are in a battle for market share and, in some cases, survival. Knowing your cost structure can ensure that any cuts or consolidation initiatives will save the most money with minimum customer impact. Companies such as Wal-Mart and Southwest Airlines, with strong positions and the most productive cost structures in their industries, can expect to gain market share. Other companies with healthy balance sheets can do so by acquiring weak competitors.

8. Emphasize core values.

Although most companies are making employees redundant, chief executives can cement the loyalty of those who remain by assuring employees that the company has survived difficult times before, maintaining quality rather than cutting corners, and servicing existing customers rather than trying to be all things to all people. CEOs must spend more time with customers and employees. Economic recession can elevate the importance of the finance director's balance sheet over the marketing manager's income statement. Managing working capital can easily dominate managing customer relationships. CEOs must counter this. Successful companies do not abandon their marketing strategies in a recession; they adapt them.

Once again, we find ourselves in the threshold of another year coming to its natural end.
Auld Lang Syne 2008. It was a good ride, indeed!

Was it a good year for you, too? I sure hope it was, but rest assured we’ll all look forward to the New Year ahead for better times together, wouldn’t we?

I’m sure the next 12 months and more will bring tests and tribulations but with the fortitude of an optimist, I say, be assured all will be well! It will and would be!

Throughout the past 365 days, we have had gains and losses, happy news and bad news, embarrassments and proud moments. Made new friend and lost old dear friends.
As you’ve probably heard- An optimist stays up until midnight to see the New Year in but A pessimist stays up to just to make sure the old year leaves. Well, I guess that makes most of us optimistic pessimists?

At this time last year the floods in Johor was all the rage in the media and our minds and within the last few weeks the coming Financial maelstrom is in everyone’s mind I’m sure. To the general populace I pray and wish: May all your troubles last only as long as your New Year's resolutions!

As for me personally: I'm a little bit older, a little bit less angry, a little bit rounder, but still none the wiser.

When the clock strikes twelve on December 31st, people all over the world will cheer and wish each other a very Happy New Year. For some, this event is no more than a change of a calendar. For others, the New Year symbolizes the beginning of a better tomorrow. So, if you look forward to a good year ahead, spread happiness to one and all by smiling in the New Year 2009!

It was an adventureous weekend for some of us here in Melaka as our friends and unit owners from S'pore and Melaka got together for a weekend drive to Penang Island on a Jalan-Jalan Cari Makan Convoy!
With stopovers in Dengkil,Selangor; Greenville in Ipoh; Pulau Penang, Butterworth; & Bidor, all the friends on the trip throughly enjoyed themselves eating, drinking & making merry this wonderful season of jOy and fraternity:)

Members of the Corporation and friends are invited to join us on the 13/12/2008 for a "Jalan-Jalan Cari Makan" convoy to the Isle of Penang for a 2 night 3 day excursion. Our dear friend Mr. Robert Lim and wife will be heading the convoy of friends and family for a weekend of fun and pleasure! So far 22pax has confirmed !!

7.00am - Assemble at Selat Horizon / Casuarina Park

7.15am - Last minute brief and taking of Q&A.

9.30am - Exit 214 Rest point at Denkil R & R ( 20 mins )........KajangSatay ??.........try your luck and see if the stall is ready !If stalls are not ready for us, no worries...........stretch and refreshand we can go on to the next R & R........Sg Buloh.

10.30am - Sg Buloh R & R ( 113 ) - overhead restaurant. Here, you can top up petrol, have Dunkin Donut etc, etc. Do a headcount prior to moving !!

11.00am - Lets move on to the next Exit 137 - Simpang Pulai to get to Ipoh...... YUM YUM Restaurant for lunch !! After lunch, a little bit of shopping for tit-bits etc.

12.30pm - Lets continue with our journey to Penang. Back to NS Highway.

2.30pm - Exit 161.....we are on Penang Bridge ......keep to the rightside after bridge on coastal rd.

Good evening Folks!

Welcome once again to the update on the latest happenings in Selat Horizon Condominiums, Melaka! But Hey ! Guess what? Anybody knew that once Malacca used to have a Full Bodied GIN named after her? We did ! They don't make them anymore though, but anyone having a full bottle can now sell them for US 280.00 a bottle ! (Even the empty bottle are selling over the collectors forums!) WOW!

This week I wish to concentrate on the Maintenance and Plumbing reports we have for you.

Attached are some pictorials on the Concrete Grouting we have implemented in the Hydrant Water Tanks and Main Water Tanks. Ever since our managements inception here 3 years ago, the Water Tanks had been a potential problem area due to the severe leakages and constant repair needed.This was further compounded by the cost/reports submitted by many contractors we invited to provide a solution to our problems. Many quoted in excess of

RM 23,000 for the repairs to the 2 Tank areas.

Thank fully, with the help and expertise of Engineer Lim Heng Toh (P02/04) we found a cheaper method of solving our perennial problem. The Grouting methodology (as below) suggested by our councillor managed to save us 75% in repair cost compared to the earlier estimates!

The last few days prior to Deepavali also saw a sudden increase in the metered water usage in one of our many water meters which struck my maintenance guy as odd. Upon tracing the problem, we ruled out water meter as faulty and concluded the water was escaping underground due to a leak in the piping. A qualified plumber was invited and they verified our earlier assesments. We then proceeded to rectify the problem through by passing the old rusty piping conduits and installing new poly-carbonate pipes to the assess areas.
Luckily the damage was limited as we caught the problem early!

Above is a picture of the latest addition the council approved for the residents in Selat Horizon Condominiums. It is the concreting of the second car wash area to help facilitate ease & convinience to the residents who utilise this facility.

Well, that was some of the major works this condo saw the last 10 days or so.

Thank you tremendously for the HUGE turnout at the Mandarin Gardens last weekend as we the Managing Committee and Manager are overwhelmed by your attendance, goodwill and time spent with us.

As evidenced by these pics, the issues related to Selat, the situation as she is in today, the rental prospects, and property outlook were hot issues discussed and given rapt attention by all attendees.

Tha hall was filled with friendly faces and many owners took the time to enunciate their requirements to the council members for the property and her future gearing.This sessionwas warmly accepted by all Committee members and Manager as it is seen as an endorsement of the council's vision for Selat 's future.

Contemplative Plenitude for this Holy Month

Modern man's life is rather clumsy, for although we pretend to control our destinies, by and large it be an act of ultimate self deception that we control the myriad trials and tribulations of what we sow, although it is true our actions and/or inaction precludes certain options to our current state, but, i believe for the most part, we are careless things that blunder along the path of history until we eventually get to our appointed destinations.

All of this, of course, points to the quaint parochialism of the modern man's- 'Id' state ( state of subconscious mind) which is, for most, a rather crude and blunt instrument at best.

The root of today's myriad problems troubling our societies is the question of identity (yours and mine) and the perpetuation of that identity over time.

(as popeye famously said; I am what I am, and that is all that I am!)

This, incidentally, is a question that is both personal as it is philosophical; and the individual, has to be made to look into the mirror of self-doubt to see the glimmer of reason tucked behind the cloud of untruths (in the Nietzschean sense).

It has, in short, to be made to ask the same existentialist questions that we are all bound to ask ourselves sooner or later:

“what am I; why am I here; is this all I am; is this all I can be?”

Instructive in this respect, i believe, is the dialogue between the semi-divine hero Arjuna and the God Krishna that takes place on the eve of the great battle of Kurukshetra, (5000 yrs ago in India) which makes up the theme of the Bhagavad Gita, (equivalent to a Holy Book for Hindus) and which, incidentally, happens to also be one of the most important works of localised Hindu literature in Southeast Asia, locally rendered as the Hikayat Pandawa Lima.

Unable to lay his soul to rest the warrior-prince Arjuna contemplates the folly of life and the madness of power on the night before the great battle between the two warring clans of the Pandawas and Kurawas, cognisant of the fact that regardless of the outcome the battle will spell the doom of both.

Gnawing at his conscience is the perennial conundrum that he is unable to resolve: How can he, the warrior-prince, obey and comply with two apparently contradictory moral orders, the dharma of the just man who must respect life, and the dharma of the warrior who must destroy life itself?

It is Lord Krishna himself, (In one of his 10 reincarnations) who comes to Arjuna’s aid by offering him sage counsel that is equally relevant to the modern man of today.

Krishna reminds Arjuna that life is full of contradictions and that as a human being one of the first conditions to be met while living in the here-and-now is to accept, understand and live with these seemingly contrasting contradictions.

Arjuna (as a man) has to protect life, but he also has to kill (to protect a life).

He must be both prince and warrior, protector and killer. Having to bear the burden of both obligations is his destiny and he cannot escape this. ( As is the case with all of us, we have to be hunters and warriors and also husbands and protectors of virtue in our family life)

Arjuna was then faced with the last temptation before the great slaughter at Kurukshetra. To simply give up.

He longs to relinquish all sense of responsibility, to escape, to deny his own agency and responsibility, to refuse to act, to do nothing.

But it is then that Krishna reveals himself in all his magnificent universal plenitude and shows Arjuna in no uncertain terms that Life is far greater than the individual.

While the warrior-prince is forced to do battle with his conscience, (in this life) Krishna reminds him that Life and one's soul is far greater, more complex, much richer than the finite conscience of the individual; (To understand today, one has to understand our yesterdays-or past lives and visualise what that impact will be on our tomorrows-or next life) and that even if the greatest of heroes cannot reconcile such contradictions in him, Life is far more abundant and expansive and great enough to reconcile all contradictions within itself.

That is the promise of the Lord.

The moral of the Bhagavad Gita – of which there are many – is that inaction is no escape from the complexities of life and that submission to Life means accepting the complexities, contradictions and paradoxes that make up mottled landscape of living itself. No, we cannot run from our fears and anxieties and we cannot gloss them over with counterfeit simple solutions either.

As a web consultant /entreprenuer/manager, I cannot refrain myself from entertaining hot prospects. No matter how small their budget is, I’ll find ways to give my sincerest advice. Many a times we show clients evidence of how our consultation gives the lead clients’ incremental savings in cost and maintenance over a period of time that is above and beyond what they are charged.

Yesterday was different. I received a call from a lead. He explained what he wanted in his web design, blah, blah, blah this & that. I’m sure I could fill the blank field in details he conveniently left out. The web is my playground, peanuts…

"I want it by Monday if possible", he said, in his snobbish bossy style.

I figured he’s the bullying type, cheapskate but talk-cock, ‘perasan classy’ and crass. But that isn’t enough to vent my anger back to him in this holy month.

So I listened tentatively to what he said, anticipating my turn to hit back.

Some how between the lodes of spittle and nasty breath interjected, I squeezed in this "We’re not of the same class. If you want Kancil, go to Perodua, but if you want Mercedes, come to me",

I gave him that thoughtful analogy to consider, thanked him and dropped the call. If he’s smart enough, he’ll relate.

There’s a golden rule in service/consultation industry; you can only get 2 of the following:

· Cheap
· Fast
· Quality

Its remarkable how in this day and age people still feel they can shout and bully their way in for better discounts, cheaper rates, and how the world owes them a living

Dear readers, to another glorious wet and warm August month here in Selat Horizon Condominiums! Compiled below are some of the decisions and actions presided over by the Management Council of Selat Horizon Condominiums, Melaka at the last council meeting conducted in July '08 for your info and perusal.

Financially,as we head towards the second quarter of our Financial Calendar, our month to date collections has surpassed last year‘s collection by RM8,598.41 with Advance Payments made by owners at RM15,650.92 to date. (This is a great validation & endorsement to the Management Council and the MA by the unit owners of SHMC!)

Recently the MA, Gunabalan brought members of the managing council's attention to the many letters written by owner, Allen Kee (M01/06) on past issues, one of them being the teak trees that were planted in Year 2006 .
On this matter, Councilor HT Lim said that the trees planting decision was made collectively by council and MA, Gunabalan should not be held responsible for suggestion made as approval for implementation is given by managing councils.
Councilor Michael Banerji advised that SH managing councils were the body that decides and approved, thus (owner of M01/06)Allen Kee should engage with the managing council on this matter.

We have recently started submitting to the corporation members through email, current maintenance works & pictures and the cause of the problems involved with a summary of action taken as per council request as they believe many unit owners are not aware of the daily workings of the maintenance and service works here in the condominiums.

We are happy to say, it was well received by many owners.

Unit owner of M06-12 attended the last July 08 council meeting and made queries about the actions of certain self serving unit owners which he felt has caused confusion and upset, amongst owners of Selat Condominiums.

Councilors, John, HT Lim and Michael Banerji updated him on the happenings in Selat to which the owner (M06/12) felt that current SH Managing Council members should draw a line and take stern and forceful action against these myopic group to eliminate future confusions and upsets.

He is happy to note that council is doing things for the betterment of the condo and will continue to support the existing managing council members. He also wants more routes be created to provide better communication between the unit owners and the current council members for the betterment of all.

On the Annual Dinner '08 arrangements, it was agreed unanimously by all councillors,that a dinner is to be held on 30th August 2008 in conjunction with Malaysia's Merdeka Celebrations.

MA, Gunabalan will suggest and plan for the Dinner. MA has also been directed to inform all owners of the party thru emails, notices and newsletter.

So, to all readers, tenants, residents, friends of SH......

The MA is pleased to announce as of 06/08/2008, the required quantum of replies for the issue of LIFT UPGRADING has been received, and the Managing Council's request to have pertinent technical breakdown and info, visuals of Lift Upgrading project pasted on the notice boards of the condominiums for the info of all has been implemented.

A discussion on car park allocations was made in the last meeting among the councils, whereby on the S&P, all owners will be provided with a car park.

Currently because of availability, all owners has been given 2 free access cards for car park entry plus their Tenants are allowed to purchase an additional 2 cards.

Though this methodology currently creates no problems and adds to the appeal of this condominiums to tenants, for future control issues, members of the council will limit card issuance especially for unit with tenants.

It was proposed that a maximum 2 cards is to be issued to any one unit and if the unit is tenanted, then the owners can opt to give their cards to the tenants or have the tenants pay for their cards @ RM30/card (max 2 cards) with the condition that office will disable the owners cards to ensure a maximum of 2 cards policy.

The World Heritage Committee meeting in Quebec City has added eight new cultural sites to UNESCO’s World Heritage List on the morning of the 7 of July.

With these inscriptions, Papua New Guinea and San Marino enter the World Heritage List for the first time.

The new sites inscribed are:

Melaka and George Town;

Historic cities of the Straits of Malacca (Malaysia) have developed over 500 years of trading and cultural exchanges between East and West in the Straits of Malacca.

The influences of Asia and Europe have endowed the towns with a specific multicultural heritage that is both tangible and intangible.

With its government buildings, churches, squares and fortifications, Melaka demonstrates the early stages of this history originating in the 15th-century Malay sultanate and the Portuguese and Dutch periods beginning in the early 16th century. Featuring residential and commercial buildings, George Town represents the British era from the end of the 18th century.

The two towns constitute a unique architectural and cultural townscape without parallel anywhere in East and Southeast Asia.

As far as item on "Upgrading of five (5) lifts at Selat Horizon" is concerned, I would like to place an objection as I believe there was supposed to be another meeting (the last one was held on 5.6.2008 with the YB Datuk Bandar, MBMB at his office) with the YB Datuk Bandar between the Council "yang baru" and Council "yang terbaru", so as to resolve the current disputes between the two (2) parties.

Furthermore, we are talking about the high cost of more than RM75k, which would definitely take away a huge chunk of our "Maintenance & Sinking Funds" account.

As such, in my opinion and I strongly feel that this project should be held in abeyance until such time this dispute issues have been resolved by the YB Datuk Bandar. I believe that the YB Datuk Bandar was trying to resolve the issue by suggesting an equal representation of Unit Owners from both parties in the Management Corporation for Year 2008

I would suggest that the MA and Council engage the services of a law firm to counter-claim against these people and also obtain an injunction restraining them of using the letter head or in any way to present themselves as representatives of the condominium.

Previously, the ex-management had requested upgrading the lifts but later there is poor response. For some owners, it is easy for them to say "Hold the Horse"But it would be better that some information’s like maintenance check report be effected.
I believed that the lifts are old enough. It's time to be safer for higher rise residences that the lift be upgraded. Why don't compared to the poor paint work done by the ex-management which cost a lot from the pool. Why now there are some small number of voices so authoritative. When it need to be done , "Do it". The lifts are old . Safety is the number one concern. Why wait????? Please have my vote on upgrading.

It was an eventful past week for all of us here as we were hosted by on Monday night by John Ng and his wonderful team in the UIC Building,Shenton Way Chinese restaurant for a night of friendship building and network bonding.
It was a good start to the new month ;)

Later in the week also saw us hosting another wonderful event in Harpers,Melaka for our very own Mr.Robert ,surrounded by good friends and happy memories.

MINUTES OF 3RD ANNUAL GENERAL MEETING
held on 15th March 2008 at Selat Horizon Resource Centre

The 2007 Annual General Meeting Of Selat Horizon Management Corporation, Melaka was called to order by Mr. Michael Banerji who has volunteered to be the Master of Ceremony (MC) for Selat Horizon 3rd Annual General Meeting at 2.29 p.m. with the following numbers of parcel owners registering in: -

A. Total proxies received- 104.
B. Qualified to vote - 39.
C. Attendees - 18
(Qualified to vote)

For quorum purposes item B + C equals to 57. As per the Strata Title Act 1985, the meeting fulfills its quorum obligations if it has 50% of total eligible unit owner. The Strata Deed poll totals that amount as 101 unit owners.

He was at this juncture interrupted by Madam Rosemary Lee of Parcel No. M01-06 who demanded to check on all proxies before start of meeting.

Further to this, Mr. Chew Chin Tai of Parcel No. M07-12 also posted a question on the validity of the proxy before the meeting is allowed to start. Mr. Chew Chin Tai of Parcel No. M07-12 pointed out that the council has failed to use the proxy form provided in the Strata Title Act which he claimed to be more relevant and transparent.

Mr. Michael Banerji of Parcel No. M09-10 explained to the floor the application for proxy which is also an instrument for quorum of a meeting and that, even if there's no proper form given, a simple hand written letter of authorization from a parcel owner can also be taken as a proxy if that owner had so given his authority to another person to vote on his behalf.

Mr. Chew Chin Tai of Parcel No. M07-12 further questions on the validity of the 3rd Annual General Meeting as he stressed that the 2nd Annual General Meeting (AGM) was not valid. At this point,Madam Rosemary Lee agreed with Mr. Chew Chin Tai of Parcel No. M07-12 that the 2nd AGM was not valid.

On rebutting this matter, Madam Chan Pek Li of Parcel No. P02-04 voiced her disagreement to the point raised as she was present during the 2nd AGM and pointed out that Mr. Chew Chin Tai of Parcel No. M07-12 had registered in , personally participated in the issues and actually participated in all the voting processes on resolutions tabled and council nomination process.

At this point, Madam Rosemary Lee of Parcel No. M01-06 who has earlier handed out some documents to parcel owner presents without the authorization of the council chair again agreed with Mr. Chew Chin Tai of Parcel No. M07-12 that the 2nd AGM was not valid.
Mr. Lim Heng Toh of Parcel No. P02-04 then stood up and pointed out that if the 2nd AGM is not valid, then how did the 2nd Management Council could have sat in the office for the last 12 months? He informed that Madam Rosemary Lee of Parcel No. M01-06 had also participated in the previous council nomination and voting process and that she herself was nominated and voted in as a council member but had chosen to refuse attending any council meeting.

At this juncture, Ms Angeline Joseph of Parcel No. P07-05, suggested for parcel owners present to vote whether the 2nd AGM is valid and whether to continue with the 3rd AGM. Madam Chan Pek Li of Parcel No. P02-04 agreed with her suggestion.

In this point, MC, Mr. Michael Banerji of Parcel No. M09-10 asked all parcel owners present to decide on whether to continue with the meeting or call it off.

Mr. Chew Chin Tai of Parcel No. M07-12 pointed out that he does not want to accept the proxies given to John Zing as he personally feel that it is illegal.

MC, Mr. Michael Banerji of Parcel No. M09-10 confirmed that the said proxies were legal and once again called for the decision to continue with the meeting.

Ms Angeline Joseph of Parcel No. P07-05 who has travel from Kuala Lumpur for this meeting then proposed to call off the AGM.

MC, Mr. Michael Banerji of Parcel No. M09-10 then explained that if the AGM is called off, the next AGM must be held next week.

Mr. George Yeo of M08-05 at this juncture,further pointed out that other condominium is charging a much lower Maintenance rate and questioned why the maintenance fund rate is not being reduced in Selat Horizon.

At this juncture, Madam Rosemary Lee of Parcel No. M01-06 informed all parcel owners that if she and her team were to sit as managing council, she promises to reduce the maintenance fund and shall work freely without any traveling claim.

Mr. Lim Heng Toh of Parcel No. P02-04 pointed out he will willingly resign as council if Madam Rosemary Lee of Parcel No. M01-06 has her team ready to take office.

MC, Mr. Michael Banerji of Parcel No. M09-10 explained that current council will step down but a proper election of council members need to be adhered to in order to bring in a new team of council members for Selat Horizon Management Corporation.

Mr. George Yeo of M08-05 once again called for management transparency and the advertisement for new Managing Agent. He also suggested that when an open tender is called for, everyone must be present when a tender is open.

Mr. Tan Chai Kun of Parcel No. M09-06 proposed to decide on whether to continue or call off the meeting as he feels that it is a waste of time to be bickering when the meeting cannot even proceed as per agenda. Madam Chan Pek Li of Parcel No. P02-04 agreed and called for show of hand from all present to determine whether to continue with the meeting.

A total of 12 out of the 19 parcel owners present voted to continue with the meeting.

However, before the meeting could be continued, MC, Mr. Michael Banerji of Parcel No. M09-10 was once again interrupted by Mr. Chew Chin Tai of Parcel No. M07-12, who challenged that even a parcel owner without strata title can be allowed to vote.

MC, Mr. Michael Banerji of Parcel No. M09-10 explained that only parcel owner holding a strata title and had paid off all outstanding arrears can be allowed to vote.

Mr. George Yeo of M08-05 requested for Mr. Chew Chin Tai of Parcel No. M07-12 to further explain his observation.

Mr. Chew Chin Tai of Parcel No. M07-12 read out Section 37 of the Strata Title Act to all present and later points out that all his proxies is a purchaser and that it allows him the right to vote on their behalf. He further pointed out that Section 37(2) which MC, Mr. Michael Banerji of Parcel No. M09-10 referred to has been deleted from the Act on 12th April 2007.

MC, Mr. Michael Banerji of Parcel No. M09-10 explained that without acknowledging the proxies, the meeting cannot continue.

Madam Chan Pek Li of Parcel No. P02-04 asked whether the council accept the proxies given, to which council member, John Zing of Parcel No. M04-12 replied "Yes, the council accepted the proxies".

Madam Chan Pek Li of Parcel No. P02-04 stressed that majority parcel owners has the right to decide on the validity of the proxies and it should not be determined by 1 or 2 person whom did not agreed to the number of proxies received.

After much disagreement and discussion, for the sake of continuing the 3rd AGM, it was agreed that parcel owners without strata title and no arrears be eligible to vote and meeting was put on hold at 3.21 p.m. to check on eligible proxies. MC, Mr. Michael Banerji of Parcel No. M09-10 then invites Mr. Chew Chin Tai of Parcel No. M07-12 to validate his proxies.

Meeting was call to order again at 3.34 p.m.:-

MC, Mr. Michael Banerji of Parcel No. M09-10 announced that we have enough quorum to proceed with the meeting since total number of owners allowed to vote was 101 members as of 15/03/2008. Only 50% of this amount is required to meet quorum.

MC, Mr. Michael Banerji of Parcel No. M09-10 then invites former Council member, John Zing to address all parcel owners present on behalf of the 2007 Managing Council as per agenda.

1.0 SHMC Chairman's Address

Council member, John Zing of Parcel No. M04-12 thanks all parcel owners present for taking the time to attend the 3rd AGM. He informed all on the many improvements made in Selat Horizon and he feels the results is visible to all owners and has benefited all residence of Selat Horizon.
He is however sad to note that the councilwoman appointed previously not only refused to work as a team with other current council members but has only put forth many allegations of grievances.

Mr. John Zing ended his speech with thanks to his fellow council members and on behalf of the councilors gave thanks to all unit owners for their support to the MC throughout their term as SHMC Council members.

2.0 Confirmation and adoption of 2nd Annual General Meeting minutes

MC, Mr. Michael Banerji of Parcel No. M09-10 then calls for confirmation and adoption of the 2nd AGM minutes.

Mr. Tan Chai Kun of Parcel No. M09-06 proposed to confirmed and adopt the 2nd AGM minutes.

Mr. Lim Heng Toh of Parcel No. P02-04 seconded Mr. Tan Chai Kun's proposal.

At this juncture, Madam Rosemary Lee of Parcel No. M01-06 and Mr. Chew Chin Tai of Parcel No. M07-12 once again interrupted the meeting proceeding by calling for the proxies given to Mr. John Zing of Parcel No. M04-12 to be considered null and void.

Mr. Chew Chin Tai of Parcel No. M07-12 asked MC, Mr. Michael Banerji of Parcel No. M09-10 that if he were to walk out now, whether the meeting will still have quorum to proceed.

MC, Mr. Michael Banerji of Parcel No. M09-10 replied and pointed out that his attendance has been recorded and yes, the meeting will still proceed.

Upon hearing this, Madam Rosemary Lee of Parcel No. M01-06 accuses the previous council members of being Power Crazy and threatened to walk off too if the meeting continue.

Mr. Tan Chai Kun of Parcel No. M09-06 requested that Madam Rosemary Lee of Parcel No. M01-06 to allow the meeting to continue and addressed her grievances according to agenda or if she insist of walking out on the meeting, to do so in order for meeting to proceed. He further stressed that he wants Madam Rosemary Lee of Parcel No. M01-06 to guarantee full responsibility of the condominium if she does not want to acknowledged a council corporation.

Mr. Tan Chai Kun of Parcel No. M09-06 further asked if either Madam Rosemary Lee of Parcel No. M01-06 or Mr. Chew Chin Tai of Parcel No. M07-12 has put forth any resolutions to sack the councils.

At this point, at 3.58 p.m. Mr. Chew Chin Tai of Parcel No. M07-12, Madam Rosemary Lee of Parcel No. M01-06, Mr. George Yeo of M08-05 and Madam Nancy of Parcel No. P05-02 walked out of the meeting. Puan Rosfah of Parcel No. M03-06 later also moved out of the meeting.

Parcel Owner, Mr. Wee Fui Twee of M05-01 walked-in at 4.05 and signed on the register list.

3.0 Treasurer Report for Financial Year 2006 and Year 2007
– To adopt and receive

MC, Mr. Michael Banerji of Parcel No. M09-10 calls for any queries on the audited report for both Year 2006 and Year 2007.

No queries were brought forward.

Mr. Brian Joseph of Parcel No. P07-04 proposed to adopt and receive Year 2006 & Year 2007 audited report.

Mr. Tan Chai Kun of Parcel No. M09-06 seconded Mr. Brian Joseph's proposal.

4.0 To decide whether to increase insurance for fire beyond RM31 million

MC, Mr. Michael Banerji of Parcel No. M09-10 calls for parcel owner's attention to this matter as it was pointed out by Mr. Anthony Cho of Parcel No. M10-09 in the 2nd AGM that the sum insured for fire which was for RM24 million is not sufficient and should be increased.

As the expiry date of the insurance is in the period of previous council in office, the councils have taken the deliberation to purchase the insurance for fire to be insured at RM31 million.

Previous council member, Mr. Lim Heng Toh of Parcel No. P02-04 explained to all parcel owners present that it was a unanimous decision by all council members to purchase coverage for fire insurance at RM31 million as it is the maximum coverage allowed by Persatuan Insurance Am Malaysia without the endorsement of chartered valuers. If we were to decide for a higher coverage, we are allowed to do so only with endorsement of chartered valuation agents, which will incur an additional RM 30,000 for valuation cost.

Mr. Goh Ngian Wa of Parcel No. M01-02 remarked that paying only an additional difference of RM633.28 for an additional fire insurance coverage of RM 7 million is a very good deal. He however asked to ensure that the current insurance covers earthquake and wanted to know the current market value to determine the coverage.

Mr. Lim Heng Toh of Parcel No. P02-04 feels that the insured amount of RM31 million is sufficient unless the property market goes up.

MC, Mr. Michael Banerji of Parcel No. M09-10 calls for parcel owners present for their decision.

It was unanimously agreed by all parcel owners present to maintain the sum insured for fire insurance at RM31 million.

5.0 To decide whether to confirm or vary any amounts determined as contributions to the Management and Sinking Funds, and also to inform all and sundry of charge in method for Maintenance and Sinking Funds, as per Strata Title Act 1985.

MC, Mr. Michael Banerji of Parcel No. M09-10 calls for parcel owner's attention to The Strata Title Act 1985 which is the governing Act for all Strata Title Properties and the instructed that all collection of Maintenance & Sinking funds be appropriated through a method identified as the share unit method as opposed to the square feet method currently applied.

A Licensed Valuer, Jurukur Semasa, had been approached last year to calculate the variance in monthly payment and details had been posted in the AGM documents to all owner.

MC, Mr. Michael Banerji of Parcel No. M09-10 calls for parcel owners present for their comment.

Mr. Goh Ngian Wa of Parcel No. M01-02 felt that the increase is not significant especially if it's according to the law.

Ms Angeline Joseph of Parcel No. P07-05 commented that as long as it's required by the law, we should comply.

It is unanimously confirmed and agreed by all present that the May-June 2008 billing for Maintenance & Sinking Fund shall follow the unit share method.

6.0 To decide whether to amend, add or repeal the By-Laws in force for Selat Horizon Condominiums

MC, Mr. Michael Banerji of Parcel No. M09-10 calls for parcel owner's attention to a resolution raised by Parcel Owner for M01-12 who calls to include in the By-Laws of the Condo to allow Managing Office / Council the authority to impose on tenants disciplinary actions and / or compel owners to abide on tenancy rules.

It is unanimously agreed by all present that the proposed clause to be included into the By-Laws of the Condo.

7.0 Resolutions Proposed

7.1 MC, Mr. Michael Banerji of Parcel No. M09-10 informed all parcel owners present that there were two resolutions received as below: -

Proposed by: Parcel No. P08-02

1. To empower the Management Council the expenses of up to RM10, 000.00 for the purpose of yearly decorations making up of festive and national events.

2. To empower the Management Council an expenses of up to RM10, 000.00 for organizing annual get-together for owners, staff recognition and yearly party.

Proposed by: Parcel No. M01-12

1. To build windows to cover common pathway in Mutiara block "C" as it is dangerous to kids and always wet after rain.

2. To include addition to By-Laws of Condo to allow Managing Office / Council the authority to impose on tenants disciplinary actions and / or compel owners to abide on tenancy rules.

3. To propose Managing Council to be approved a budget of RM20,000.00 for twice yearly dinners (RM4,000.00 X 2 dinners for 200 pax), staff recognition luncheon (RM4,000.00), expenditure for Public Holidays decorations (RM5,000.00 for 4 major events) and any additional as seen fit by the Managing Council.

7.2 MC, Mr. Michael Banerji of Parcel No. M09-10 pointed out that one of the resolutions is related to the By-Laws which was earlier discussed and agreed upon unanimously.

7.3 He further called attention for all Parcels Owners present to a similar proposed resolution which is to empower the Managing Council a sum / budget to organize annual get-together and party for owners, expenditure for Public Holidays decorations and staff recognition luncheon.

On this matter, Mr. Edward Lee of Parcel No. P01-01 agrees to the proposal and even put forth a suggestion to increase the amount specified by an additional RM 2,000.00.

Mr. Goh Ngian Wa of Parcel No. M01-02 agrees to the request of organizing annual gathering but proposes to cap it to RM12, 000.00. He felt more maintenance and upgrade works should be looked into especially on the current lift.

Mt. Tan Chai Kun of Parcel No. M09-06 proposes a budget of RM15, 000.00 for annual gathering and such as proposed in the resolution.

After much deliberation, it is agreed by all Parcel Owners present to allow a budget of RM12, 000.00 for annual gathering and such.

7.4 MC, Mr. Michael Banerji of Parcel No. M09-10 then proceeded to read out the resolution on " To build windows to cover common pathway in Mutiara block "C" as it is dangerous to kids and always wet after rain".

Madam Chan Pek Li of Parcel No. P02-04 asked for more clarification on the actual area requesting for the installation of windows at common pathway and the cost. MC, Mr. Michael Banerji of Parcel No. M09-10 explained that it is for Mutiara Block "C" and the quotes received is on a range of RM24,000 to RM48,000.00 depending on the material use.

After much deliberation, all Parcel Owners present did not agree to the installation of the window as requested.

7.5 As there were no other resolutions being proposed, MC, Mr. Michael Banerji of Parcel No. M09-10 brought to attention that all resolutions has been addressed, tabled and dealt with according to agenda.

8.0 Election of Management Council Members

MC, Mr. Michael Banerji of Parcel No. M09-10 announces that there were only 7 nominations for council members being put forth. As nomination of a council member is allowed during the AGM, he called upon all Parcel Owners presents to nominate more local Parcel Owners and participate in the upkeep of Selat Horizon Condominium.

He further pointed out that in the 2nd AGM, it has been tabled and agreed to adopt 9 council members plus two co-opt which is to be authorized by the Management Council.

As there were only 7 nominees, Mr. Lim Heng Toh of Parcel No. P02-04 proposes to nominate Mr. Tan Chai Kun of Parcel No. M09-06 and Mr. Brian Joseph of Parcel No. P07-04.

His proposal is seconded by Mr. Michael Tan of Parcel No. M03-05 and Mr. Ben Soon of Parcel No. M01-12.

Both nominees accepted the nomination which resulted in the following formation of the new Management Council.

As pointed out by MC, Mr. Michael Banerji of Parcel No. M09-10 the Management Council is authorized to appoint additional council members by co-opting, Mr. Michael Tan of Parcel No. M03-05 proposed to invite Ms Linda Teo of Parcel No. P06-01 and Ms Angeline Joseph of Parcel No. P07-05 to join the Management Council as members.

His proposal is seconded by Mr. Ben Soon of Parcel No. M01-12.

Both nominees accepted the invitation to be co-opted into the Management Council team for year 2008.

9.0 Any Other Business

9.1 MC, Mr. Michael Banerji of Parcel No. M09-10 brought Parcel Owners present attention to the matter on a suggestion to do a complete Termite Treatment on the grounds of the condo property. Last treatment done was 8 years ago. The quote received is at RM22, 700.00.

Mr. Goh of Parcel M01-02 felt that unit owners should do termite treatment on their individual property. He felt that it is much more effective to curb the problem at own unit. It is much more cost effective that way.

Ms Angeline Joseph of Parcel No. P07-05 agrees with Mr. Goh of Parcel M01-02.

Mr. John Zing of Parcel No.M04-12 explained that he had earlier proposed to get all owners to do a selective block of termite treatment which he feels is much more cost effective.

It is agreed that the Management Council to do a proposal of such and open the option to all Parcel Owners to do a termite treatment as a group.

9.2 Mr. John Zing of Parcel No.M04-12 took the opportunity to explain to all Parcel Owners present that the Management Council decides and control the overall upkeep on the Condo. Managing Agent only acts as an agent to supervise decisions made by the Management Council and advises the Management Council on areas of improvement as deemed necessary. Final decision still is at the prerogative of the Management Council members.

He clarified to the floor the individual and separate tasks of the Management Council and Managing Agent. He further pointed out that the Management Council and Managing Agent's office had been harassed by the Kee's and lawyer Chew. The transparency they keep harping on is done and unit owners were also invited to the council monthly meetings to discuss the upkeep of the Condo. Many improvements have been implemented in this manner.

9.3 At this juncture, Managing Agent, Gunabalan requested permission to speak. He informed to all that the AGM for Year 2007 also faced harassment from the same unit owners who have their own personal agenda to fulfill. But even then, many of their accepted grouses and grievances were attended to, all of which were made known to PTG ( as the then governing body ) and action has been taken to overcome the perceived grouses.

10.0 Adjournment

MC, Mr. Michael Banerji thanked all Parcel Owners present for their participation and the AGM was adjourned at 4.29 p.m.

The Myth of Competence and a Happy Life in General

Of late, it has become painfully obvious to me that long professional Sabbaths are bad for my generally lackadaisical disposition in life as after 3 years in this current phase of my life, I am clearly lacking the patience and am slow to the draw with certain insidious characteristic traits a person in my trade encounters. Generally, I have discovered that people who are incompetent generally lack the knowledge that they are incompetent.

The argument is, broadly, that "the incompetent / generally ignorant also tend to be the blissfully self-assured... because the skills required for competence often are the same skills necessary to recognize competence."

Or in other words - as we were wont to say:
You can't really blame the incompetent for not knowing they're incompetent, given that they don't really understand the tools or the terminology which are used to measure competence!

I confess, Aging gracefully I ain’t!

I have had rated communication and customer relationships as primary focuses in my early career and ambition scorecards, but after a long leave of absence from my kin (the consultancy, guide and hospitality trade), the primary instincts are waning. These were the bread and butter issues of my youth. These were the leadership traits I self consciously emulated from those I looked up to. These were the people, places and events of industry where I cut my teeth all those long years ago.

If I were to write an epitaph of those early years, it would have been this quote John Wayne gave when questioned on what he thought of his early life:

....."I pretended to be somebody I wanted to be and I finally became that person. Or he became me. Or we met at some point.” End Quote.

Certain incidences of late has brought to the fore my need /greed to be with the mead and meat groups and how an inescapable truth in my life was / is I am a glutton for the mutton of life.
Damm the consequences!

Life is meant to be enjoyed but there in lies the truth of definition.

How does one classify “happiness”? Is it the term you recount from the good book? Is it the Term you recount from what society desires of you?
Or be it the term you discover encapsulates what you THINK?

I THINK, THEREFORE - I AM. (Agis Quod Agis- Whatever you do, do it well is a school motto I am fond of reciting at most times( with mead and meat in hand!) but the shine is waning on the old girl as I grow longer in tooth)

To recap, facing the general insufferables /plebs in life is getting to me.

And it’s getting to me simply as I realize with brighter clarity that my life is not getting any longer and the only things in life I can look forward to is the inescapable truth that as I keep growing longer in the tooth, all that I hold dear and true will go away, and no amount of money can change that.

What am I talking about, you ask?

My Father –in –Law is dying of inoperable cancer.

It’s not as if the old fart and I were the best of buddies or anything, but he did put up a good fight when I waltzed into his lovely daughter’s life one fine day and out of the blue he woke up to the realization that he suddenly had a son–out of–law to share his daughter’s love with..

Thanks but no thanks were the general mood of those times between us but over the years, the stark differences of earlier years looked pale in comparison to the similarities we shared as adults and fathers.

Curses and Woe be upon the young man who dares to touch my daughter heart!

But there in lies the tragedy of the Family man. You give and give and what do you get? Your loved ones taken away from you. (why do you think they make a big deal of the ritual of “giving away the daughter”? )

But, I’m digressing.

It will be hard to see my better half coping with this loss she has to face. Her loss will be our loss in more ways than one as it brings forth so many unexplored emotions and feelings.I wish there was a better way for us to accept the truths in life but life’s truth is painful at the best of times.

And so it is that we face another day .
